These conditions are valid only between the company Maria Meucci 1948 of Meucci Giulia, with registered office in Via Granaio, 41, 59016 Poggio a Caiano, (Prato) Italy, VAT number 02417380975, hereinafter referred to as “Supplier” and any person who carries out purchases online on the mariameucci.it website; hereinafter referred to as “CUSTOMER”. These conditions govern purchases made on the mariameucci.it website, in accordance with the provisions of part III, subheading III, chapter I, of the Italian Consumers Code, Italian Legislative Decree no. 206/2005, amended by Italian Legislative Decree. no. 21/2014 and the GDPR 2016/679
Identification of the Supplier
The assets covered by these general conditions are put up for sale by the
company Maria Meucci 1948 of Meucci Giulia, with registered office in Via Granaio, 41, 59016 Poggio a Caiano, (Prato) Italy, VAT number 02417380975, registered at the Chamber of Commerce of Prato PO-533703 of the Register of Companies, hereinafter referred to as “Supplier”.
-With the term “online sales contract”, we mean the purchase and sales contract relating to the Supplier’s movable property, stipulated between them and the Customer as part of a remote sales system through telematic tools, organised by the Supplier.
The term “Customer” means the consumer who is the physical person who makes the purchase, as per this contract, for purposes not related to commercial or professional activity.
-The controller of the collection and processing of personal data is the Supplier to whom the Purchaser may direct, at the headquarters of ADLP, each request.
ARTICLE 1 – Subject of the contract
With these general conditions of sale, Maria Meucci 1948 sells and the CUSTOMER remotely purchases the tangible movable goods indicated and offered for sale on the site www.mariameucci.it The contract is concluded exclusively through the Internet, through the access of the CUSTOMER to www.mariameucci.it and the creation of a purchase order according to the procedure provided for by the site itself. The customer undertakes to examine these general terms and conditions of sale prior to confirming the order, in particular the pre-contractual information supplied by MARIFLOS, and to accept them by ticking the box indicated. In the email confirmation of the order, the customer will also receive the link to download and store a copy of these general terms and conditions of online sale, as required by art. 51 paragraph 1 of Italian Legislative Decree 206/2005, amended by Italian Legislative Decree 21/2014.
ARTICLE 2 – Pre-contractual information for consumers – art. 49 of Italian Legislative Decree 206/2005
The CUSTOMER examines the characteristics of the goods, as described on the individual product data sheet when selected by the CUSTOMER, prior to confirming the purchase agreement.
Before the validation of the order with “payment obligation”, the CUSTOMER is informed with regard to:
– the total price of the goods inclusive of taxes, with details of shipping and any other costs;
– the payment method;
– the deadline by which Maria Meucci 1948 commits to deliver the goods;
– conditions, terms and procedures for exercising the right of withdrawal;
– the existence of a legal guarantee of conformity for goods purchased;
ARTICLE 3 – Confirmation and validity of the agreement
The sending of an email confirmation by Maria Meucci 1948 to the Customer is considered as confirmation of the agreement. The email contains the CUSTOMER’s data and order number, the price of the goods purchased, the delivery costs, the address to which the goods will be delivered and a link to print and store a copy of these conditions.
The CLIENT undertakes to verify the correctness of the personal data contained in the aforementioned email and to promptly notify Maria Meucci 1948 of any corrections/changes to be made.
Maria Meucci 1948 undertakes to describe and present the items sold on the website in the best way possible. Nevertheless some errors, inaccuracies or slight differences between what is shown on the website and the actual product may occur. Additionally, any photographs that appear on www.mariameucci.it are representative only and do not constitute any part of the agreement.
Maria Meucci 1948 undertakes to deliver the goods within 10 days of the sending by Maria Meucci 1948 of the email confirming the order to the CUSTOMER.
ARTICLE 4 – Availability of products
Availability of products refers to current availability at the time the CUSTOMER makes the order. This availability must however be considered purely indicative as:
– the products could be sold to other CUSTOMERS before confirming the order, due to the simultaneous presence on the site of multiple users,
– an IT anomaly could occur such as to make available to purchase a product that in reality is not.
Even after sending the order confirmation e-mail sent by Maria Meucci 1948, there may be cases of partial or total unavailability of the goods. In this case, the order will be corrected automatically with the elimination of the product or products not available and the CUSTOMER will be immediately informed by e-mail; with this e-mail the customer will also be informed of the methods and timing of repayment of the sums that may have been paid.
ARTICLE 5 – Payment method
Each payment by the CUSTOMER can be made by Visa, MasterCard, Maestro credit cards and by bank transfer. The actual charge of the order amount will occur only when the order is complete and ready for shipment.
Any communication relating to payment and CUSTOMER data at the time these are sent is made via special secure lines. The security of payment by credit card is guaranteed by VBV (Verified by VISA) and SCM (Security Code Mastercard) certification, through Banca Sella spa, via Cavour branch, 74/r, 50129, Florence, VAT number 02224410023.
ARTICLE 6 – Prices
All sales prices for products shown on the www.mariameucci.it website are in euros and are inclusive of VAT.
Shipping costs and customs fees are included in the purchase price.
The CUSTOMER accepts the ability of Maria Meucci 1948 to change its prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time of the creation of the order and indicated in the confirmation e-mail sent by Maria Meucci 1948 to the CUSTOMER.
In the case of computer, manual, technical, or any other type of error that may result in a substantial change to the retail price, either substantially higher or substantially lower, which was not intended by Maria Meucci 1948, the purchase order will be considered invalid and cancelled, and the amount paid by the CUSTOMER will be refunded within 14 days from the day of cancellation.
ARTICLE 7 – Right to annulment
In accordance with the legal provisions in operation, the CUSTOMER is entitled to annul the purchase, without penalty and without specifying any reason, within 14 days from the date the goods are received.
In case of multiple purchases made by the CUSTOMER with one order and delivered separately, the period of 14 days shall run from the date of receipt of the last product.
The CUSTOMER who intends to exercise the right of withdrawal must communicate this to Maria Meucci 1948 by means of an explicit declaration, which can be sent by registered mail or by downloading the computerised practice of Reso from the www.mariameucci.it website.
ARTICLE 8 – Legal guarantee of conformity
In the event of receiving Products which are not compliant with orders, the CUSTOMER has the right to remedy the product by repair or replacement at no extra cost. The CLIENT can exercise this right if the defect is challenged within two (two) days from the delivery date.
In the case of defective or non-compliant products, Maria Meucci 1948 will arrange, at its own expense, to organise the collection of the product, compatibly with the CUSTOMER’S availability.
ARTICLE 9 – Commercial guarantee
All products presented on the mariameucci.it website benefit, as well as the legal guarantee of conformity referred to in the previous article, from a commercial guarantee whose duration is quoted on the product’s product sheets.
To use the warranty, the CUSTOMER must keep the invoice that will be sent together with the goods delivered as well as being sent in advance by email. After the invoice has been issued no changes can be made to the details contained therein.
ARTICLE 10 – Delivery method
The products will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order, no later than 10 days from the date of receipt by the CUSTOMER of the order confirmation email sent by Maria Meucci 1948.
The CUSTOMER can verify the traceability of the goods by accessing the link that will be sent directly by the courier contracted with the Supplier.
Article 11 – Liability
Maria Meucci 1948 assumes no liability for disruption due to force majeure or unforeseeable circumstances, even where caused by malfunctions or Internet service disruptions, in the event of failure to complete the order within the time period foreseen by the contract.
ARTICLE 12 – Site Access
The CUSTOMER has the right to access the site for reference and to make purchases. The site and its contents may not be used for any other purpose, especially for the purpose of trade. All elements used on this site, both visual or audio, and related technology, are the property of Maria Meucci 1948 and are protected by intellectual property rights.
ARTICLE 13 – Cookies
The website www.mariameucci.it uses “cookies”. Cookies are electronic files which record information relating to the CUSTOMER’s site navigation (pages consulted, date and time of consultation, etc.) and allow Maria Meucci 1948 to offer personalised service to its customers.
Maria Meucci 1948 informs the Customer that they may disable the creation of these files by accessing their internet settings menu. Disabling cookies will prevent the Customer from making online purchases.
ARTICLE 14 – Integrality
These General Terms and Conditions of Sale are constituted by the totality of the clauses of which they are comprised. If one or more provisions contained in these General Terms and Conditions of Sale is considered invalid or declared as such pursuant to law, regulation, or following a decision by a court of law, the other provisions will continue in full force and effect.
ARTICLE 15 – Applicable law and competent court
These General Terms and Conditions of Sale are subject to Italian law. All disputes arising from this contract will be referred to the Chamber of Commerce of Prato, and resolved according to the Conciliation Rules adopted by it.
If the Parties intend to refer to the ordinary judicial authority, for any dispute that may arise from or in relation to the contract between the parties, it will be subject to the exclusive jurisdiction of the Court where the Supplier has its registered office.
